La Policía de la Ciudad incautó mas de 1.400 litros de aceite sin certificación para consumo humano a lo largo de una investigación de cinco meses, que incluyó operativos en la vía pública y bares y restaurantes de distintos barrios porteños. Todo comenzó en abril cuando personal de la División Contravenciones y Faltas Contra el Orden Público de la Policía de la Ciudad, que se encontraba finalizando un operativo en la intersección de la avenida Corrientes y la calle Agüero, vio que un hombre descargaba varios bidones de aceite comestible de una camioneta Citroën Berlingo.
Los oficiales se acercaron al sujeto y le solicitaron la documentación personal y el permiso para transportar sustancias alimenticias, que no tenía. Los bidones de aceite no contaban con ningún tipo de identificación bromatológica e iban a ser entregados en distintos restaurantes de comida peruana de la zona.
Como consecuencia, los oficiales labraron las correspondientes actas, secuestraron el vehículo y las botellas de aceite por un total de 920 litros.
Ante este hecho, la Unidad Fiscal Especializada en la Investigación de Delitos Vinculados con Estupefacientes (UFEMA), a cargo del doctor Carlos Rolero Santurián y ante la Secretaría del doctor Ricardo Bomparola, ordenó llevar a cabo una investigación para dar con la procedencia de la sustancia.
La continuidad de esta investigación se centró en locales gastronómicos que utilizarían ese producto sin habilitación de la ANMAT, disponiendo el fiscal la realización de seis inspecciones en bares y restaurantes en Balvanera, Recoleta y Palermo.
Las inspecciones fueron llevadas a cabo por efectivos de la División Contravenciones y Faltas Contra el Orden Público de la Policía de la Ciudad junto a agentes del Cuerpo de Investigaciones Judiciales (CIJ), la Dirección General de Control Ambiental (DGCONTA), la Dirección General de Higiene y Seguridad Alimentaria (DGHYSA) y la ANMAT.
De los procedimientos, los oficiales secuestraron otros 492 litros de aceite en 41 bidones recargables, los cuales no tenían las medidas necesarias de salubridad.
Como resultado de los seis procedimientos, se labraron actas por faltas de seguridad e higiene, por no contar con la documentación y por el correspondiente acopio de aceites vegetales. Además, también quedó documentada la falta de matafuegos en la cocina y la escasa limpieza en las áreas de acopio del producto.
La Fiscalía actuante dispuso labrar actas por “ejercicio ilegal de una actividad” y secuestrar la totalidad del aceite como así también entregar muestras del mismo a la ANMAT.
