A los pocos días, la policía irrumpió en la casa de Cristina Vázquez acusando del delito a ella, a una amiga y a su pareja. El nombre de la joven apareció espontáneamente y sin justificación en la causa: una mujer declaró haber visto a la pareja de su amiga vendiendo joyas que serían de la vecina de Cristina y, por lo tanto, se decidió condenarlos a los tres a prisión perpetua. Dicha mujer aportó testimonio una sola vez, no se la volvió a convocar y jamás se encontraron pruebas ni de la existencia de las joyas ni de otros testigos.
En la instancia de juicio oral, dos personas declararon haber estado con Cristina a 8 kilómetros de Posadas aquella noche. Ambos testimonios fueron descartados. En la escena del crimen no hay rastros ni huellas de la condenada, así como tampoco hay testigos directos que acrediten su culpabilidad. En el expediente, se atribuye a Cristina el tener un estilo de vida “promiscuo y marginal”, “ser mentirosa” y “ser adicta a la marihuana”. A partir de esta construcción apoyada en un juicio moral, se decidió condenar a Vázquez a perpetua basándose en un testimonio de la instancia de instrucción en el año 2005, en el que supuestamente un testigo habría dicho que Vázquez admitió su crimen estando bajo el efecto de las drogas. El presunto testigo explicó en la instancia oral que no recordaba haber tenido tal conversación con Vázquez y que en la etapa de instrucción había sido arrestado para ir a declarar. Sin embargo, su declaración fue tomada como prueba de cargo en la instancia condenatoria.
Las irregularidades en el caso son múltiples. Las mismas fueron presentadas por el Observatorio de la Asociación de Pensamiento Penal (APP) mediante un amicus curiae (recurso “amigo del tribunal”) frente al Tribunal 1 de Posadas. La misma ONG estableció que hay una ausencia absoluta de perspectiva de género, que derivó en las inferencias arbitrarias que se hicieron respecto al estilo de vida y subjetividad de Cristina.
La certeza es que, en este momento, Cristina Vázquez lleva nueve años privada de su libertad en la Unidad Penal N°5, Instituto Correccional de Mujeres, en Posadas. Compañeras y organizaciones demandan el esclarecimiento de la causa y las irregularidades sobre las cuales se funda su condena.
Quienes acompañan a Cristina y exigen su inmediata liberación realizaron el siguiente video para difundir y visibilizar la situación de la mujer misionera.
