El hecho ocurrió por la noche cuando efectivos de la Comisaría Vecinal 15A se desplazaron hasta una vivienda ubicada en la manzana 9, en el citado barrio de emergencia, por una denuncia de ruidos molestos.
Cuando los agentes llegaron constataron la presencia de música que provenía de un pasillo, parlantes y un equipo de sonido con unas siete personas bailando en un espacio cerrado.
Al consultar con la propietaria, la misma manifestó que estaban celebrando un cumpleaños con familiares que no eran de la zona, por lo que se procedió a desalentar dicha reunión.
En la causa intervino la Fiscalía Penal, Contravencional y de Faltas Nº4, a cargo del Dr. Tereszko, Secretaría Única del área de flagrancia de la Dra. Ramírez, que dispuso la notificación de los siete presentes, de entre 19 y 55 años, de los cuales seis eran de nacionalidad peruana.
