En Sesión Ordinaria Mediante una reforma a la ley que establece el régimen de faltas, se aumentó el lapso de dos a cinco años para hacerlo concordar con el plazo máximo de valor de las licencias de conducir.
Las faltas por infracciones de tránsito prescribirán a los 5 años, como lo dispuso la Legislatura de la Ciudad de Buenos Aires mediante una modificación a la Ley 451, que es el régimen de faltas.
La proposición de procedimiento fue mostrada por el diputado Daniel Presti (PRO) presidente de la Comisión de Justicia, y obtuvo 37 votos positivos, 15 negativos y 2 abstenciones.
Los compendios sustentaban que “la ampliación de la prescripción en las faltas de tránsito encuentra justificación en que el plazo estándar de vigencia de la licencia de conducir es de cinco años y el certificado de libre deuda de faltas que extiende la Dirección General de Administración de Infracciones es uno de los requisitos fundamentales para su renovación”.
Tambien, se estableció el plazo de prescripción en 5 años de forma tal que la jurisdicción persecutoria de la administración no se liquide antes del vencimiento del término por el que se otorgan las licencias de conducir. Se gestiona así que los transgresores den obediencia a la obligación de pago de sus multas.
Asi como la Ley Nacional de Tránsito N° 24.449 y sus modificatorias pone dos plazos de prescripción diversos, para las labores con causa en faltas leves, dos años, y por faltas graves, cinco años.
“Sustituyese el artículo 15 del Anexo A de la Ley N° 451 (texto consolidado Ley N° 5.666), por el siguiente texto: Artículo 15.- PRESCRIPCIÓN La acción en el régimen de faltas prescribe a los cinco (5) años de cometida la falta”, indica la norma competente sobre tablas a pedido del Poder Ejecutivo.
