Las leyes sancionadas durante el pasado 2016 en la Ciudad dejaron sabor a poco.
Durante las dos últimas sesiones del año parlamentario porteño, la Legislatura de la Ciudad Autónoma de Buenos Aires aprobó una serie de normas de interés general que incidirán sobre la vida de sus habitante y transeúntes.
La temática fue muy variada y se menciona a continuación una breve lista resumida de los principales asuntos:
Las buenas:
CONTRA EL ACOSO: Se aprobaron tres leyes, una que “tiene por objeto prevenir y erradicar toda forma de acoso u hostigamiento escolar (bullying)”; otra para “prevenir el ciberacoso sexual contra menores de edad (grooming)”, y una tercera contra el acoso sexual en los lugares públicos, con penas contravencionales de multas y trabajos comunitarios para casos de intimidación u hostigamiento.
ESPACIO VERDE: Se creó el “Parque de la Estación”, en terrenos linderos con la terminal ferroviaria Once de Septiembre del Ferrocarril Sarmiento. Se trata de 20.000 metros cuadrados actualmente en desuso, el equivalente a dos manzanas, que formaban parte de la estación de trenes y que ahora se convertirán en espacio público para los vecinos de Balvanera y Almagro (Comunas 3 y 5), que son quienes menos espacio verde por habitante tienen en toda la Ciudad de Buenos Aires. 15 años de movilización y lucha sostenida de lxs vecinxs dieron sus frutos.
Buenas pero….reiterativas, innecesarias, incompletas o muchas veces incumplidas o no implementadas:
URBANIZACIÓN DE VILLAS: Mediante sendas leyes, se aprobó el marco normativo para las reurbanizaciones de Villa Fraga (o Playón Chacarita) y Villa Rodrigo Bueno, asentada en la Costanera Sur, sobre parte de la Reserva Ecológica. Antes se había dispuesto la reurbanización de la Villa 20 (en Lugano) en el marco de la construcción de la Villa Olímpica para los Juegos Olímpicos de la Juventud 2018, y de las villas 31 y 31 bis, en el barrio de Retiro.
Es un mandato constitucional la urbanización de las villas. Se han sancionado ya muchas leyes durante estos 9 años del Gobierno del Pro pero no se han cumplido ninguna. Ver para creer.
PERSONAS CON DISCAPACIDAD EN EL SUBTE: “El Gobierno de la Ciudad deberá implementar soluciones tendientes a garantizar el acceso de personas con movilidad reducida a la totalidad de las estaciones de la Red de Subterráneos de Buenos Aires”, es el texto de una norma aprobada en la última sesión ordinaria. Es una ley completamente declarativa. Que reitera lo que ya dice la Constitución Nacional, la de la Ciudad y los tratados internacionales. Ya era obligatorio y lo lo cumplen! Más que decir de nuevo hay que hacerlo!
EL ZOO SE CONVERTIRÁ EN ECOPARQUE: Acorralados los funcionarios de la Ciudad x habrás corpus en defensa de los animales, amparos y denuncias penales, finalmente los/as diputados/as del PRO aceptaron tratar la iniciativa que hablamos presentado en 2012 y sancionaron el marco legal que permitirá poner en marcha un proceso de “transformación progresiva” del histórico Zoológico de Buenos Aires, para que deje de ser un hábitat artificial de animales en cautiverio y pase a convertirse en un Ecoparque interactivo. Sin embargo años de movilizaciones pidiendo el cierre del zoo se ven defraudados al no permitir la participación de los/as expertos/as y protagonistas de la iniciativa desde la sociedad civil. . El esta ley en su artículo 11 permite trasladar los animales o venderlos a otro zoo, algo que es visto por los animalistas como un #ecofraude.
ACCESO A LA INFORMACIÓN PÚBLICA: “Toda persona tiene derecho a solicitar y a recibir información completa, veraz, adecuada y oportuna. Para ejercer el derecho de acceso a la información pública no será necesario acreditar derecho subjetivo, interés legítimo o razones que motiven la petición”, sostiene una ley sancionada hoy por Legislatura porteña. Se trata de la actualización de la ley 104 de 1998. Sin embargo resulta insuficiente para asegurar el derecho de acceder a la información pública de los habitantes de la Ciudad y es, en varios aspectos, menos protectoria que la ley nacional recientemente sancionada.
CONTRA LAS “PICADAS”: Fue sancionada una ley que tiene por objeto concientizar a la población, prevenir los daños, disuadir de la práctica y promover el desarrollo de infraestructura que impida la realización de competencias de automóviles en la vía pública que carezcan de la debida autorización . La Secretaría de Transporte será la autoridad de aplicación y el que desarrollará “las acciones para alcanzar su implementación efectiva a partir del 2018”. Las picadas ya estaban prohibidas. Falta control y acabar con la impunidad.
CONTROLES DE HIV: Se aprobó una ley que busca promover la demanda voluntaria de los controles de VIH o HIV y concientizar sobre la importancia de llevarlos adelante como método de prevención de la enfermedad. “El Ministerio de Salud llevará adelante acciones de difusión relativas a promover la demanda voluntaria de los test rápidos de VIH”, dice el texto legal. No suma demasiado a lo que ya eran derechos vigentes y pone en evidencia la falta de políticas activas en la materia.
JUEGOS DE AZAR: A través de una ley se estableció la disolución del Instituto de Juegos de Apuestas porteño y la creación de una Sociedad del Estado (Lotería de Buenos Aires) que tendrá las atribuciones y estructura necesarias para ejercer plenamente la competencia en materia de juegos de azar. Otro organismo burocrático pero no se aborda la cuestión de fondo. Hay Juegos de azar en la clandestinidad en nuestra Ciudad como el casino y los tragamonedas. Que hace la Ciudad par a evitar la ludopatia?
Depende como se lo mire:
FALTAS DEL TRÁNSITO: Las faltas por infracciones de tránsito prescribirán recién a los 5 años, según lo dispuso la Legislatura mediante una modificación a la Ley 451, que es el régimen de faltas.
Si se trata de un semáforo en rojo o alta velocidad sin duda está bien. Peri la mayoría son las arbitraría faltas x mal estacionamiento y curro de las gruas mediante que ahora se extenderán a toda la Ciudad.
TRÁNSITO RESTRINGIDO POR EL CENTRO: Las cuadras del microcentro de la Ciudad de Buenos Aires por donde no podrán circular automotores en días hábiles y en horarios laborables se multiplicarán por tres, mediante una aplicación gradual que se iniciará el 1 de abril de 2018 y concluirá en julio de 2019. Hoy la veda vehicular rige (desde hace 40 años) en las calles que están dentro del polígono formado por Av. Alem, Viamonte, Carlos Pellegrini y Av. de Mayo, hasta el bajo. Esa zona se extenderá incorporando los alrededores de Tribunales (el área entre Av. de Mayo, Cerrito, Av. Córdoba y Montevideo) y ampliando el microcentro hacia el sur (casco histórico), hasta la Av. Belgrano, entre Paseo Colón y Bernardo de Yrigoyen; y hacia el norte, hasta la Av. Santa Fe.
Compartimos y apoyamos la peatonalización y las limitaciones a los autos, pero estás no pueden darse son mejorar el transporte público, cosa que no ha ocurrido en estos años mi con Subte ni con colectivos. Además no se ha hecho con diálogo y planificación y esto implicara pérdida de puestos de trabajos en garajes u playas de estacionamientos en esas zonas.
AUTÓDROMO: Tuvo aprobación definitiva la ley que permitirá mejorar el estado actual del tradicional circuito del barrio de Villa Lugano, y establece para la puesta en valor del Autódromo, un plan integral deportivo y comercial. Lástima que el espacio está totalmente privatizado y esta puesta en valor no podrá ser disfrutada gratuita y públicamente por los/as vecinos/as de Villa Riachuelo.
Las malas:
AUTOPISTA ILLIA: La Legislatura porteña aprobó en forma definitiva la ley que autoriza construir una nueva traza de la Autopista Arturo Illia, desde su empalme con la avenida 9 de Julio hasta la actual estación de peaje, fingiendo que su objeto se vincula con la reurbanización e integración de las villas 31 y 31 bis en el barrio de Retiro. En lo que hoy es la traza de la autopista urbana se proyecta poner plantas sobre el asfalto y el cemento. Construir un nuevo trayecto de la autovía, de 1.900 metros de largo, con puentes y otras obras de infraestructura es puro negocio: autopista innecesaria en lugar de construir de una buena vez las casas
PASEO DEL BAJO: Se aprobó en primera lectura (falta hacer una Audiencia Pública) un Convenio Urbanístico con la Nación que habilita la venta de tierras en Catalinas Norte para financiar las obras del Paseo del Bajo, un corredor vial de 6 kilómetros de extensión que conectará el Puerto de Buenos Aires y la Autopista Buenos Aires – La Plata con la Autopista Illia. Obra manifiestamente insustentable y cara, que arrasa con la posibilidad de conectar norte y sur y puerto vía trenes de cargas. Implicará más camiones y más autos en la Ciudad!!!!Había opciones más baratas y no contaminantes que no se consideraron
Las muy malas que logramos parar:
El Shopping en Caballito, los Solares de Santamaria o pequeña Dubai en la ex Ciudad deportiva de Boca y el Nuevo Código de Planeamiento urbano que institucionaliza el extractivismo urbano.
La mayoría de las leyes aprobabas por la legislatura en 2017 siguen siendo declaraciones de ciudadanos/as ilustres, reconocimientos a personalidades destacadas y poner o cambiar nombre a calles, plazas y estaciones de Subte.
