El Colegio Profesional Inmobiliario se presentará en el Tribunal Superior de Justicia de la Ciudad para que revise el fallo que declaró la nulidad de la resolución que habilitaba este cobro.
La Sala Primera de la Cámara en lo Contencioso Administrativo y Tributario de la Ciudad de Buenos Aires le concedió al Colegio Profesional Inmobiliario el recurso para que el Tribunal Superior de Justicia (TSJ) revise el fallo que declaró la nulidad de la resolución que habilitaba el cobro a los inquilinos de dos meses de comisión.
Recordemos que, a principio del año pasado la Asociación Civil Inquilinos Agrupados y la Asociación Civil por la Igualdad y la Justicia nos presentamos en la Justicia porteña con una acción de amparo contra el Colegio Profesional Inmobiliario por emitir una resolución que habilitaba a sus matriculados a cobrar dos meses de comisión a los inquilinos.
Desde el 2007 está vigente la Ley 2340, que es su artículo 57 establece que las inmobiliarias no pueden cobrar a los inquilinos una comisión mayor al 4,15% del valor total del contrato, lo que representa aproximadamente un mes de alquiler. Esta ley fue sistemáticamente infringida por las 6000 inmobiliarias de la Ciudad durante casi 10 años.
Cuando desde Inquilinos Agrupados comenzamos a denunciar este incumplimiento, el Colegio emitió la resolución 350 en la cual habilitaban a sus matriculados a cobrar dos meses de comisión. En ese momento, nos presentamos en la Justicia denunciando la inconstitucionalidad de que un Colegio Profesional regule los honorarios máximos de sus matriculados, que ya estaban regulados por una ley local.
Tanto el juez de primera instancia –Marcelo Segón– como la Cámara en lo Contencioso Administrativo y Tributario de la Ciudad -Sala I- nos dieron la razón e impidieron que se siga cobrando dos meses de comisión en la Ciudad de Buenos Aires. Terminaron, de esta forma, con una transferencia ilegal de 1500 millones de pesos anuales del sector de los inquilinos al mercado inmobiliario. Asimismo, la sentencia judicial condenó al Colegio a ejercer un control integral sobre sus matriculados, con miras a evitar que se repitan este tipo de ilegalidades.
Lejos de cumplir con el control de sus matriculados, el Colegio sigue planteando recursos judiciales y ahora van a llegar al Tribunal Superior de Justicia de la Ciudad. “Evidentemente el Colegio no tiene la decisión de cumplir con lo que dicta la ley, por lo tanto, hay que rediscutir quien tiene que controlar a las inmobiliarias de la Ciudad de Buenos Aires”, afirmó Gervasio Muñoz, Presidente de la Asociación Civil Inquilinos Agrupados
Y agregó “No hay ninguna razón ni argumento para pensar que el inquilino es un cliente de la inmobiliaria, y como tal deba pagar una comisión para firmar un contrato de alquiler. Por eso, el próximo desafío que tenemos los inquilinos es que la Legislatura porteña sancione el proyecto de ley para que la comisión inmobiliaria la pague el dueño de la propiedad y no el inquilino”.
