Una investigación que la Policía de la Ciudad desarrolló por cuatro meses derivó en los allanamientos a un geriátrico y un consultorio, en Monte Castro, desde el que se promocionaba un medicamento sin autorización de la ANMAT, con supuestos fines rejuvenecedores, por el cual una médica quedó imputada.
Efectivos de la División Delitos Contra la Salud y Seguridad Personal, dependiente del Departamento Delitos con la Salud Pública de la Policía de la Ciudad, fueron encomendados por la Fiscalía en lo Penal, Contravencional y de Faltas 24, a cargo del Dr. Rodrigo Manuel Pagano Mata, a investigar una denuncia que llegó al ANMAT respecto de la promoción y venta por parte de una médica vía Instagram de Oxitocina Spray Nasal bajo la marca Oxitocim TX, que la entidad regulatoria de la medicina en la Argentina no tiene autorizado.
Los oficiales bucearon en las redes y hallaron en Instagram que la médica se presentaba como especialista en Medicina Integral, en Geriatría y Gerontología, Ozonoterapia, Nutrigenética y Medicina Anti Age, con foto de perfil con el logotipo de la marca que utilizaba, tampoco registrada en ANMAT.
“Respira la nueva medicina”, proponía en su dominio web.
La investigación de los policías llevó a dos domicilios linderos sobre la calle Benito Juárez al 2100, en uno de los cuales funciona un geriátrico y en el otro un consultorio, con la placa de la médica investigada, quien comercializaría los productos en ambos lugares.
A partir de los datos recolectados vía redes sociales y confirmado el lugar de acción de la médica, el fiscal solicitó las órdenes de allanamiento para los dos domicilios, que autorizó el Juzgado en lo Penal, Contravencional y de Faltas 21, a cargo de la Dra. Cristina Beatriz Lara.
La magistrada dispuso que el procedimiento esté a cargo de la División Delitos para la Salud de la Policía de la Ciudad junto a personal de la Oficina de Coordinación Operativa (OCO) del Cuerpo de Investigaciones Judiciales (CIJ) del Ministerio Público Fiscal, y dar intervención a la Dirección General de Fiscalización y Control de la Ciudad para realizar una amplia inspección, al igual que agentes de la ANMAT.
Durante el procedimiento, los oficiales incautaron en el consultorio el teléfono celular de la médica, que quedó imputada por infracción al Artículo 201 del Código Penal (reprime al que pusiere en venta, suministrare, distribuyere o almacenare con fines de comercialización aguas potables, sustancias alimenticias o medicinales o mercaderías peligrosas para la salud, disimulando su carácter nocivo) y los entes reguladores le labraron un acta por falta de habilitación y otras irregularidades, por lo que se clausuró el lugar.
En tanto, del geriátrico se procedió a secuestrar dos notebooks, una PC, etiquetas, volantes y rótulos que promocionaban la actividad ilícita, un listo de fórmulas de preparados y constancias comerciales de venta por Mercado Libre, 150 frascos de medicamentos con etiquetas con diferentes fórmulas, por lo que fueron enviados a una dependencia de la ANMAT para que sean analizados.
