Los cuatro procedimientos derivaron de una investigación de la División Delitos Informáticos Complejos de la Policía de la Ciudad, que logró establecer la trazabilidad de la mercadería, desde la fabricación al expendio del producto. La pesquisa se originó cuando firmas legales detectaron que se vendía ropa de marca a muy bajo precio por Internet, en su mayoría por redes sociales.
Personal de esta División llevó adelante las averiguaciones para dar con dos domicilios en la Provincia de Buenos Aires, que se utilizaban para la confección de prendas y falsificación de marcas de primera línea, y dos departamentos en el barrio de Villa Santa Rita, en los que se almacenaba ropa apócrifa para luego venderla.
En la causa actuó el Juzgado Nacional en lo Criminal y Correccional Federal Número 4, a cargo del doctor Ariel Lijo y ante la Secretaría Número 8 del doctor Martín Canero, que dispuso secuestrar toda la mercadería e imputar a los dueños de las viviendas allanadas.
Uno de los allanamientos se dio en la calle Bariloche al 1100, en Villa Celina, donde se descubrió que había un taller textil que producía buzos y remeras, con la leyenda de las marcas Tommy Hilfiger, Under Armour, Lacoste, Holliester y Abercrombie, todas adulteradas.
La ropa encontrada estaba alojada en 14 bolsones y en su interior se descubrió un total de 1.215 prendas. Además, se secuestraron 7 sobres con etiquetas de las marcas mencionadas y 4 shablones de impresión.
Allí se imputó a una mujer y se pasó a clausurar a todos los sectores del taller destinado a la confección de prendas, tras consulta previa con el magistrado actuante.
En tanto, otro allanamiento se llevó a cabo en la ciudad de Avellaneda, en la calle Olleros al 200. Esa vivienda se utilizaba como acopio de mercadería y se encontraron 20 bolsones con ropa deportiva con la insignia Adidas falsificada. En total, se hallaron 2.112 prendas, entre remeras, buzos, joggins y pantalones cortos.
Al consultar con el Juzgado interventor, se incautó la mercadería y se secuestraron dos teléfonos celulares de los residentes del lugar, una pareja que quedó imputada por la violación a la Ley de Marcas.
En Capital Federal, los oficiales se dirigieron a dos departamentos del sexto piso de la calle Magariño Cervantes al 2700, donde se encontraron prendas de una organización que las vendía por Internet. La mercadería secuestrada (4.577 prendas en 139 bultos) está valuada en el mercado en alrededor de 5.400.000 pesos.
Al momento de la intervención, en el departamento se hallaba un hombre de 62 años y su hijo de 31.
En el departamento E, los efectivos encontraron 2.093 remeras de las marcas Adidas, Lacoste, Polo, Penguin y Tommy Hilfiger, 58 pantalones Adidas y 539 buzos Lacoste y Tommy Hilfiger, toda ropa adulterada, mientras que en el inmueble F se incautaron 103 remeras Adidas, 410 pantalones Adidas, 504 calzoncillos para hombre Tommy Hilfiger, 630 calzoncillos Calvin Klein y 240 bombachas para dama Calvin Klein.
Además de secuestrar toda la ropa, se procedió a confiscar tarjetas con logos de las mencionadas marcas, las cuales se utilizaban con fines de marketing.
