El consejo de la propiedad horizontal que se creó por ley a fines del 2015 y que nunca llegó a entrar en funciones, quedo definitivamente desactivado porque se derogó la norma que lo promulgo .
El pasado 7 de Julio, la Legislatura Porteña derogó la Ley sancionada el 3 de diciembre de 2015, que creaba el Consejo de la Propiedad Horizontal de la Ciudad de Buenos Aires. La derogación fue aprobada por la totalidad de los diputados presentes en la sesión. El Consejo que estaba destinado a regular la actividad de quienes se dedican a administrar consorcios de propiedad horizontal, había generado impugnaciones por presunta inconstitucionalidad, queja de vecinos y controversias públicas.
La ley creaba un Comité Ejecutivo del nuevo organismo, integrado por 11 representantes, 3 de las cámaras de administradores de consorcios, 3 del sindicato de empleados de edificios, 1 de organizaciones civiles de los copropietarios de edificios, 1 de ONG en defensa de consumidores y usuarios, 1 del gremio de los trabajadores de administradores de consorcios, 1 de la Defensoría del Pueblo y 1 representante del Gobierno, del área de defensa del consumidor.
El partido Confianza Pública apoyó la derogación de la Ley 5464. “Entendimos que esta Ley no podía funcionar de la manera como había sido aprobada”, señaló el diputado Diego García de García Vilas. “Este es un punto de partida hacia un merecido debate: teniendo en cuenta que el registro de la Propiedad e Inmueble no está funcionando, está claro que hay que trabajar sobre este tema”, agregó. García de García Vilas fue el primero en presentar un proyecto de modificación al advertir falencias en la normativa sancionada el 3 de diciembre de 2015. Si bien se intentó llegar a un consenso con los distintos espacios, la falta de acuerdos en algunos puntos sustanciales llevó a la derogación.
Frente a la sanción de esta Ley, la Cámara Argentina de la Propiedad Horizontal había presentado en el mes de febrero un amparo solicitando la inconstitucionalidad de la norma. A su vez, el presidente del Colegio Público de Abogados de la Capital Federal, Dr. Eduardo Awad, especialista en la temática consorcial, sostuvo que la Ley era lisa y llanamente, un ataque al derecho de propiedad de los consorcistas y de los administradores.
